These Terms and Conditions (“Terms”) govern your use of modushift.com, operated by Modushift and its founder, Ammar Quadri (“Modushift,” “we,” “us,” or “our”). By accessing or using this website, you acknowledge these Terms. If you do not agree, discontinue use of the website.
Website purpose
This website provides general information about Modushift and its marketing services. Website content is provided for informational and promotional purposes and does not constitute legal, financial, tax, or other professional advice.
No client relationship
Visiting the website, contacting Modushift, requesting an audit, or booking a meeting does not create a client relationship. Services begin only after the parties separately agree to the project scope, responsibilities, payment, ownership, timelines, and other applicable terms.
No performance guarantees
Marketing outcomes depend on numerous factors outside Modushift’s control, including traffic quality, products, pricing, market conditions, customer behavior, brand reputation, implementation, and platform changes. Examples, projections, audits, recommendations, and case studies do not guarantee any particular revenue, conversion rate, return on investment, or other result.
Acceptable use
You may not use the website for unlawful, fraudulent, or harmful purposes; attempt to gain unauthorized access; introduce malware or disruptive code; scrape or reproduce website content without permission; impersonate another person; or interfere with the website’s operation or security.
Intellectual property
Unless otherwise stated, the website’s branding, logo, copy, graphics, layouts, and original materials belong to Modushift or are used with permission. You may view the website for personal or internal business evaluation, but may not copy, modify, distribute, sell, publish, or commercially exploit its content without prior written permission. Third-party names, logos, and trademarks belong to their respective owners.
Information you provide
You represent that information submitted to Modushift is accurate and that you have authority to provide it. Do not send passwords, payment-card information, customer lists, sensitive personal information, or confidential business data through ordinary email or website forms unless specifically requested through an appropriate secure method.
Third-party services
The website may link to services operated by third parties, including Calendly and other platforms. Modushift does not control and is not responsible for third-party availability, content, terms, security, or privacy practices. Your use of those services is governed by their respective policies.
Website availability and accuracy
We aim to keep website information accurate and available, but do not warrant that the website will always be uninterrupted, error-free, secure, complete, or current. We may modify, suspend, or discontinue any part of the website without notice.
Disclaimer of warranties
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
Limitation of liability
To the fullest extent permitted by law, Modushift and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of—or inability to use—the website. Nothing in these Terms limits liability where limitation is prohibited by law.
Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful misuse of the website, violation of these Terms, or infringement of another party’s rights.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Changes to these Terms
We may update these Terms when the website, services, or legal requirements change. Updated Terms will be posted here with a revised “Last updated” date.
Severability
If any provision is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
